Australian Centre for the Prevention of Cervical Cancer (ACPCC, we or our) has designed and built the canSCREEN app (app) and service (Service) as a commercial app and service. The app and Service are designed to be used by an entity, organisation or government body or agency which operates a cancer screening registry or function for that purpose only. It has not been designed and is not intended for use by individuals for their own health or other purposes or by an entity for any other purpose. ACPCC excludes all liability arising from the use of the app or the Service by any person in a manner which is not in accordance with its intended purpose.
The app and Service are provided by ACPCC and are intended for use as is. This Privacy Statement should be read in conjunction with the Terms and Conditions regarding the use of the app and Service. By downloading and using the app or using the Service, you (you or user) are agreeing with the terms of this statement and the Terms and Conditions. This page is used to inform visitors how we collect, use, disclose and manage any personal information we may collect regarding the use of the app and Service. If you choose to use the app and Service, then you agree to the collection and use of information as described in this statement. Further, you should also refer to our Privacy Policy which provides further detail regarding how we manage personal information. Where applicable, the terms used in this statement have the same meanings as in our Terms and Conditions (which are accessible at canSCREEN) unless otherwise defined in this statement.
For a better experience, while using our app and Service, we may require you to provide us with certain personally identifiable information, including but not limited to your name, address and contact information. The information that we request will be retained by us and used and managed as described in this privacy statement and our Privacy Policy. The personal information that we collect from a user of the Service is collected and used so that we can manage your account and provide and improve the app and Service. We will not use, or disclose your information to any third party, except as described in this statement and our Privacy Policy.
The app and Service are intended to be used by the entities or bodies identified in the first paragraph of this statement to collect personal information, health information and other identifiable data (Personal Information) from individuals or patients for cancer screening or cancer registry purposes. A user of the Service is responsible for complying with all privacy laws, health records laws, data laws and other similar laws which which apply in their relevant jurisdiction regarding the collection, use, disclosure storage, access to and management of Personal Information from those individuals. Without limitation, a user of the app and Service agrees to provide all relevant information (including a relevant privacy statement) to, and obtain all required consents from, individuals whose Personal Information the user collects through the app or the Service which may be required under applicable laws. The user agrees to inform such individuals that ACPCC may access their Personal Information while providing the Service. Under no circumstances will ACPCC be deemed to be the collector, controller or processor of Personal Information, which is collected by a user of the Service, or assume any obligation as a collector, controller or processor. A user of the app or the Service agrees to defend, indemnify and hold harmless ACPCC from and against any claim, liability, loss or damage arising out of or in connection with a breach of any law governing the collection, management and protection of Personal Information.
Whenever you use our Service, we may collect data and information (through third-party products) from or through your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.
Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory. The Service does not use these “cookies” explicitly. However, the app may use third-party code and libraries that use “cookies” to collect information and improve their services. If you choose to refuse our cookies, you may not be able to use some portions of this Service.

These third parties may have access to a user’s Personal Information and to the Personal Information of individuals or patients that a user might input into or through the app. The reason for such access is for the third party to perform the tasks assigned to them on our behalf.
We value your trust in providing us your personal information and we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or other method of electronic transmission or storage is 100% secure and reliable, and we cannot guarantee its absolute security.
The app and Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the relevant privacy policy and Terms and Conditions of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
The Services are not intended to be used by anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13 years of age. If we discover that a child under 13 has provided us with personal information, we will immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to take the necessary actions.
A user agrees that they download and use the app and use the Service at their own risk. The app and Service are provided ‘as is’ and, to the maximum extent permitted under applicable law, ACPCC makes no warranty of any kind, express or implied, by statute or otherwise, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement in relation to them. Without limitation, ACPCC does not warrant that the app or the Service will function at all, that they will function uninterrupted, that they are error-free, that any errors will be corrected or that any data which is collected or transmitted will be secure or free from unauthorised access, corruption or loss. ACPCC will in no event be liable to a user of the Service or to any third party, whether in contract, tort, under statute or under any other legal theory for any losses, expenses or claims, including (without limitation) lost profits or revenues, loss or interruption of use or lost or damaged data, or similar economic loss, or for any indirect, special, incidental, consequential, punitive, or similar damages in relation to the use of the app or the Service. A user of the Service agrees to indemnify, defend, and hold harmless ACPCC from and against any liability, damage, loss, or expense (including reasonable legal fees and expenses) incurred by ACPCC in connection with any third-party claim, suit, action, demand or judgement under any theory of liability (including without limitation actions in tort, contract or under statute) resulting from or arising out of the use of the Service or the app by the user.
We may update this privacy statement and our Privacy Policy from time to time. You are therefore advised to review this page periodically for any changes. By downloading or using the canSCREEN app (app) and related services (Service), you (you or user) agree to comply with these Terms and Conditions. You should make sure you read them carefully before using the app and Service. You agree that by accessing the app or using the Service, you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with all these Terms and Conditions, you are expressly prohibited from using the app and Service and you must discontinue such use immediately. Australian Centre for the Prevention of Cervical Cancer (ACPCC, we, our) has designed built the Service as a commercial app and service. The Service is designed to be used by an entity, organisation or government body or agency which operates a cancer screening registry or function for that purpose only. It has not been designed and is not intended for use by individuals for their own health or other purposes or by any entity for any other purpose. The app and Service are not intended for use by any person or entity in any jurisdiction or country where such use would be contrary to law, or which would subject ACPCC to any registration or other requirement within such jurisdiction or country. A person who elects to access or use the app or Service is solely responsible for compliance with applicable local laws. ACPCC excludes all liability arising from the use of the canSCREEN app and the Service by any person in a manner which is not in accordance with its intended purpose or where the use of the app or Service contravenes any law in the applicable jurisdiction.
By using the app, you represent and warrant that:
• all information you submit to us will be true, accurate, current, and complete.
• you will use the app and Service solely for, and in accordance with, its intended purpose; and
• you will not use the app for any illegal or unauthorised purpose and your use of the app will not violate any applicable law.
The app and Service are ACPCC’s proprietary property - all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics and the trademarks, service marks, logos and copyright material contained therein or in relation to the app and Service (collectively Intellectual Property) are owned or controlled by ACPCC. Except as expressly provided in these Terms and Conditions, you must not copy, modify, reverse engineer, make derivative versions, reproduce, aggregate, republish, upload, post, publicly display, encode, translate into any language, transmit, distribute, sell, license, or otherwise exploit for any commercial purpose whatsoever, any part of the Service or the Intellectual Property without our express prior written permission. ACPCC grants the user a limited, personal, non-exclusive, revocable licence to download and use the app, and to use the Service, for non-commercial purposes in accordance with these Terms and Conditions. A user must not assign, sub-license, transfer or sell such granted license. You acquire no rights to the app or the Service or the Intellectual Property other than as specified in these Terms and Conditions. ACPCC is committed to ensuring that the Service is as useful and efficient as possible. For that reason, we reserve the right to make changes to the Service or to charge for it, at any time and for any reason. However, we will not charge you for the Service without giving you prior notice and an opportunity to cease using it. The app is designed to be used to assist you to collect personal information and health information from patients/individuals for the purpose of creating a health screening or cancer registry. You are responsible for collecting and managing that information in accordance with your requirements and purposes and in accordance with all relevant laws which apply in your jurisdiction. It is your responsibility to keep your phone (or other device you use) and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the app won’t work securely, properly or at all. The data you enter or through the app or Service will be hosted on the Microsoft Azure cloud. You are responsible for your Microsoft Azure account and all data stored on that account, including the security and retrieval of the data. You should be aware that you are responsible for ensuring your devices can use and connect to the app and Service. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider; ACPCC is not responsible for the app not working at full functionality if you do not have access to Wi-Fi, or if you do not have any of your data allowance left. If you are using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you are accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. ACPCC is not responsible for the way you use the app or Service. You need to make sure that your relevant device stays charged – if it runs out of battery you may be unable to access the Service. Although we endeavor to ensure that the app is functional, we rely on third parties to provide information to us so that we can make it available to you. We cannot guarantee the app will always be available. We may experience hardware, software, or other problems or need to perform maintenance resulting in interruptions, delays, or errors. ACPCC accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app. From time to time, we may change, modify or update the app for any reason at our sole discretion. The app is currently available on Android – the requirements for the system (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. However, ACPCC is not obligated to and makes no representation that it will maintain or support the app or that it will update the app at all or update it so that it is relevant to you and/or works on your device. If we choose to update, modify or change the app, you agree to always accept any such updates, modifications or changes. We will not be liable to you or any third party for any modification, change, suspension, or discontinuance of the app or Service. At any time and without giving notice, we may stop supporting the app, we may discontinue the app, or we may terminate the Service. If you fail to comply with the Terms and Conditions, we may immediately terminate the provision of the Service to you. Without limitation, we may, in our sole discretion and without notice or liability, deny access to and use of the app or Service to any person for any reason or for no reason and we may suspend or terminate your use of the app or Service and/or delete your account. If we terminate your right to use the app or terminate the Service in any of the above circumstances the following will apply:
(a) The rights and licenses granted to you under these Terms and Conditions will immediately end.
(b) You must immediately stop using the app and the Service, and (if directed by ACPCC) delete the app from your device(s).
(c) You hereby waive any right to make any claim against, or seek any damages or compensation from, ACPCC regarding our ceasing to support or our discontinuation of the app or the termination of the Service. If we discontinue the app or terminate the Service, it is your responsibility to retrieve and manage the data which you have collected through the app or the Service and ACPCC will have no responsibility or liability in relation to the retrieval, storage or management of that data.
A user agrees that they download and use the app and use the Service at their own risk. The Service and app are provided ‘as is’ and, to the maximum extent permitted under applicable law, ACPCC makes no warranty of any kind, express or implied, by statute or otherwise, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement in relation to them. ACPCC will in no event be liable to a user of the app or Service or to any third party, whether in contract, tort, under statute or under any other legal theory for any losses, expenses or claims, including (without limitation) lost profits or revenues, loss or interruption of use or lost or damaged data, or similar economic loss, or for any indirect, special, incidental, consequential, punitive, or similar damages in relation to the use of the app or the provision of the Service. Without limiting the foregoing, ACPCC will assume no liability or responsibility for any (a) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the app or the Service; or (b) any unauthorised access to or use of any Personal Information collected through the app or the Service or (c) any interruption or cessation of transmission to or from the app. A A user of the app and Service agrees to indemnify, defend, and hold harmless ACPCC from and against any liability, damage, loss, or expense (including reasonable legal fees and expenses) incurred by ACPCC in connection with any third-party claim, suit, action, demand or judgement under any theory of liability (including without limitation actions in tort, contract, or under statute) resulting from or arising out of (a) the use of the app or the Service by the user; or (b)a breach of these Terms and Conditions by the user.
We may update our Terms and Conditions from time to time. You should therefore review this page periodically for any changes. We will notify any changes by posting the new Terms and Conditions on this page. By continuing to use the app or the Service, you agree you have been made aware of and accept all such updates and variations to the Terms and Conditions from the date they are posted. These Terms and Conditions and your use of the app and the Service are governed by and construed in accordance with the laws of the State of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of its courts and courts of appeal from them and will not object to the exercise of jurisdiction by those courts on any basis.
